Issue 5
In Ohio, Issue 5 was voted in by 30% of Ohio's registered voters.  Tracy Sabetta, a paid for lobbyist for the American Cancer Society, likes to quote a higher figure (which gets higher with every interview she gives) but the reality is, only 30% of the registered voters passed Issue 5.  (see TRUTH for a breakdown)
Issue 5 was based SOLELY on the Surgeon General Report (Carmona 2006).  No other reports, studies or facts were given for voting for Issue 5 than this report.  The SG's 2006 report is full of flaws.  He did no studies of his own, rather he "cherry picked" what other studies, articles he wanted to support his predetermined position.  NO studies that showed NO CAUSAL RELATIONSHIP between SHS and lung cancer or heart disease were used in his report.  A formal complaint was filed by Forces International with the Health & Human Services, Office of Research Integrity citing Carmona's Report "represents a massive case of deliverate scientific misconduct, misrepresentation, fabrication and falsification". /Documents/ori_complaint.pdf  (Forces is a non profit, educational corporation).  After months, the ORI returned the complaint to Forces stating is had no jurisdiction.  If the Office of Research Integrity has no jurisdiction over a complaint filed against a report written by the top Federal Government surgeon, then who does?  This is an outrage.

From Carmona's report, 5 reasons were given for the "Explanation and Argument in Support of Issue 5.    http://http://www.sos.state.oh.us/SOS/ElectionsVoter/results2006.aspx?Section=1869  All 5 of these reasons are lies.  Two of them fly in the face of common sense. 
  • "There is no safe level of exposure" - is the most ridiculous statement a man in Carmona's position could make.  His statement levels that exposure to SHS starts a death process (if there is no safe level).  How can anyone allow him to make this claim?  Logic dictates we would all be dropping dead, not the supposed 53,000.  There are safe levels of arsenic in your drinking water but there's NO safe level of puffs of smoke?
  • "Smoke-free policies do not harm business" - an out and out lie (see Damage to Businesses).  Tell that to the former owner of THIS business (HIS business, not a business belonging to the public.  HE alone suffers the financial loss).  OoOB will be issuing a press release detailing the losses in Ohio.
